NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT PURSUANT TO THE DIGITAL MILLENNIUM COPYRIGHT ACT

 

If you believe that you hold a claim of copyright infringement against Gospel Expo or a site which we host, submit Notice of your claim to the following Designated Agent:

Notice Elements:  Your Notice must include the following:

  1. Your name, physical and Internet addresses, telephone number and your physical or electronic signature;
  2. Sufficient information to identify the work or works in which you claim copyrights;
  3. Identify the infringing matter and its Internet location;
  4. A statement by you that “you have a good faith belief that there is no legal basis for the use of the materials complained of by the allegedly infringing party”; and
  5. A statement by you that “the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner.”

We recognize that some might allege that certain items on web sites that we host may infringe certain intellectual property rights.  Consequently, we have set up specific procedures which enable verified rights owners to identify and request removal of allegedly infringing items. These procedures are intended to substantially comply with the requirements of the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. Section 512.

 

It is our policy to remove or disable items listed by third parties on our site which you claim infringe your rights. However, in order to do so, we require proper notice under the DMCA. Specifically, the DMCA requires that your notice include those elements identified above.

 

Please note that any misrepresentation of material facts by you or your representative may subject you to claims for damages and attorneys fees.

 

Furthermore, upon receipt of your notice, we shall notify the owner of the site identified in your notice and permit the owner an opportunity to respond in accordance with the DMCA.  If we receive proper counter-notification from the owner of the accused site, we may replace the removed material and re-establish access to the accused site.  We will also provide you with a copy of the counter-notification.
